1. Scope

These terms and conditions apply to all services provided by Win10-AI (company number BE0628 908 507), including website development, application development, hosting services, and maintenance.

2. Quote and Acceptance

Quotes are non-binding and valid for 30 days. An agreement is established upon written acceptance by the client or upon commencement of work after client approval.

3. Prices and Payment

All prices are exclusive of VAT (21%) unless otherwise stated. Payment term is 14 days after invoice date. In case of non-payment within the specified period, interest of 10% per year will be charged, with a minimum of €50 administrative costs.

Rates:

• Basic website/application development: €150 excl. VAT
• Modifications and updates: €50 per session excl. VAT
• Domain registration: variable, annual (€10-€30/year)
• Hosting: variable based on resource usage (€30-€1000/year)

4. Delivery Time

Delivery times are indicative. Exceeding the delivery time does not entitle the client to compensation or termination, unless the delay exceeds 60 days without valid reason.

5. Intellectual Property

Upon full payment, the client receives a non-exclusive right to use the delivered code and content. The source code remains the property of the service provider unless otherwise agreed in writing.

6. Use of AI Tools

The service provider uses AI assistance tools (GPT-4, Claude, GitHub Copilot) for code generation, optimization, and debugging. All code is reviewed and tested before deployment.

7. Hosting and Domains

Hosting and domain registration are annual recurring costs payable to the respective providers. The service provider is not liable for downtime, data loss, or service interruptions from third parties.

8. Maintenance and Updates

Maintenance and updates are billed at €50 per session excl. VAT. A session includes up to 2 hours of work. More complex modifications are communicated in advance and quoted separately.

9. Liability

Liability is limited to the amount effectively invoiced for the relevant project, with a maximum of €500. No liability for indirect damage, lost profits, or data loss.

10. Cancellation

In case of cancellation after commencement of work, 50% of the quoted amount is due. In case of cancellation within 48 hours before scheduled deployment, 100% is due.

11. Applicable Law

Belgian law exclusively applies to this agreement. All disputes fall under the exclusive jurisdiction of the courts of the service provider's registered office.

Win10-AI (BE0628 908 507) is the data controller for the processing of your personal data in accordance with GDPR.

• Contact details: name, email address
• Project information: description of requested services
• Billing details: address, VAT number
• Communication: correspondence via email

• Performance of the contract
• Invoicing and accounting (legal obligation)
• Communication about your project
• Answering questions and support

4. Retention Period

• Project documentation: up to 1 year after project completion
• Billing data: 7 years (legal obligation)
• Communication: up to 2 years after last contact

5. Sharing With Third Parties

Your data is not sold or shared for marketing purposes. We may share data with:

• Hosting providers (Hostinger) for technical infrastructure
• Payment processors for invoicing
• Government agencies when legally required

6. Your Rights

You have the right to:

• Access your personal data
• Rectification of incorrect data
• Erasure of data (right to be forgotten)
• Restriction of processing
• Data portability
• Object to processing

7. Security

We take appropriate technical and organizational measures to protect your personal data. All communication is via encrypted connections (HTTPS).

2. Technical Limitations

We strive for error-free code and 100% uptime, but cannot guarantee that developed applications are completely bug-free or that hosting services are continuously available.

3. AI-Generated Content

We use AI tools for code generation and optimization. Although all output is reviewed, it cannot be excluded that AI-generated code contains unforeseen issues. Clients are advised to conduct code audits before production deployment in critical environments.

4. Third-Party Services

We integrate with various third-party services (hosting providers, payment gateways, APIs). We are not responsible for changes, downtime, or discontinuation of these services.

5. Backups

Responsibility for data backup lies with the client. Win10-AI does not maintain long-term backups unless explicitly agreed in a hosting agreement.

6. Security

We implement industry-standard security practices (HTTPS, password hashing, input sanitization), but cannot guarantee absolute security against hacks or data breaches.

7. External Links

This website may contain links to external websites. We are not responsible for the content or privacy practices of external sites.

8. Changes

Win10-AI reserves the right to change these terms at any time. Significant changes are communicated via email to existing clients.
